Landscape or any place of outstanding historic and cultural value near cultural heritage that needs to be protected together with the cultural property is designated as the ¡®Historic and Cultural Environment Preservation Area(HCEPA)¡¯ pursuant to Article 2(6) of the Cultural Property Protection Act(CPPA), in order to regulate development in and surrounding areas. Conflicts between stakeholders, however, have occurred in a number of regions since the protection provision was established in 2011, due to the confusion of policies over the provision in the process of permitting and regulating urban and rural development plans and activities. In particular, the actual condition that the protection and management of the HCEPA near designated cultural properties fail to be implemented systematically due to discrepancies between the CPPA and legislation relating to urban planning and national land planning also aggravates this phenomenon. This study analyses cultural heritage policies of the UK, which developed into complementary relationship with national land planning in the 21st century, in an attempt to establish the systemicity of policies on the HCEPA, enhance the implementation capacity of local governments, and find significant implications for ensuring consistency with national land planning. To compare cultural heritage protection systems between South Korea and the United Kingdom, historic and cultural environment in South Korea corresponds to ¡®Historic Environment¡¯ in the United Kingdom, the HCEPA to ¡®Setting,¡¯ and cultural property to ¡®Heritage Asset,¡¯ respectively. Based on the analysis of background to historic environment and setting policies and their operating system in the United Kingdom, suggestions for enhancing acceptability of the regulation of development activities near Korean cultural heritage, particularly, in the HCEPA are as follows: First, systems of close cooperation between national and local planning agencies should be constructed in connection with the conservation of the HCEPA, and there should be systemicity and consistency between related plans so that areas near designated cultural properties may be managed harmoniously within the urban planning system. Second, for the sustainability of the HCEPA, comprehensive and flexible approach to the whole historic environment is required. Third, phased mid- and long-term approach is required, such as informed decision-making, enhanced local resident participation, and improvement in stakeholders¡¯ consciousness about historic and cultural environment. And fourth, the authority and roles of local governments should be expanded with respect to the HCEPA. |
