| 요약1 |
설계·시공일괄발주방식은 1996년 ‘턴키공사 활성화 대책’ 이후 턴키공사의 비율이 꾸준히 증가함에 따라 활발하게 적용되고 있다. 이에 발맞추어 공사계약에 관한 법률 또한 설계·시공일괄발주방식에도 부합하도록 변화하는 추세에 있다. 하지만 기존의 설계·시공분리 방식에 기초한 틀을 벗어나지 못하고 일부분만을 변화시킨 공사계약일반조건을 사용함으로서 많은 클레임이 발생하고 있고 공사수행 간에 더 많은 리스크를 내포하는 요인이 되고 있다. 따라서 본 연구에서는 기존의 설계·시공 분리 방식에 적용되던 공사계약일반조건을 개선시켜 설계·시공일괄발주방식에 적합한 공사계약일반조건을 제시하려고 한다. |

The Use of Design-Build order which is capable of contract in construction industry has been increased continuously since 1996. However, the design-build order has not been applied successfully to the projects. One of the important reason is that Korean government use existing General conditions of construction contract and does not make an effort to reform it. The purpose of this research is to analyze problems of existing General conditions and to suggest methodology to improve General conditions. |
